Long Island Nursing Home Abuse Lawsuits

P arker Waichman LLP has a dedicated team of nursing home abuse and neglect attorneys whose sole focus is protecting the rights of your loved ones. We want to trust nursing homes to adequately care for the elderly in need of medical assistance; unfortunately, some facilities fail to provide the proper care for their residents. Even worse is the fact that many residents cannot communicate that they are being abused, meaning that a number of cases are undetected.

Get the Facts about Nursing Home Abuse

Nursing Home Abuse Knowing the facts about nursing home abuse can help you determine if your loved one is a victim. Firstly, you should be aware that nursing home abuse is more common than one would hope. According to a 2009 CBS article, a congressional report revealed that nearly one-third of 1,600 nursing homes have been cited for abuse.

Nursing home abuse can happen in numerous ways. Nursing home staff can inflict physical abuse, meaning the non-accidental use of force that causes pain, injury or impairment. Physical abuse is not limited to hitting or shoving, however; it also includes the misuse of medication, restraints or confinement. Nursing home residents can suffer emotional abuse when someone speaks or treats them in a manner that causes emotional pain or distress; this includes intimidation, humiliation or constantly blaming them for something. Sexual abuse of the elderly, meaning contact with an elderly person without their consent, can also occur in nursing homes. This type of abuse can involve the direct commission of sexual acts by the staff, or activities such as the staff displaying pornographic material.

Neglect is common among victims of nursing home abuse; it is reported in half of elderly abuse cases. Neglect can be intentional or unintentional: the bottom line is that the elderly person is not properly treated.

In instances involving nursing home residents who can’t tell you directly – for whatever reason – that they are being abused, it is important to look for signs of it yourself. In our years of experience, Parker Waichman has found that the five most common signs of nursing home abuse and neglect overlooked by caretakers are:

•    Bedsores
•    Weight loss
•    Bruises and injuries with an unknown origin
•    Inattentive staff
•    Falls

According to the CDC, nursing homes with 100 beds typically report 100 to 200 falls a year – but then many incidents go unreported. About 1.5 million nursing home residents exist in the United States; as many as half will fall at least once a year, with many suffering multiple falls during that time period.

Poorly Rated Nursing Homes in New Jersey

Some nursing homes abuse residents by attempting to make them more docile via the over-administration of antipsychotic drugs. The Record reported on a resident at Norwood Care & Rehabilitation Center who became violent and hateful toward her family – due only to the antipsychotic medications that she’d been dosed with. “There was a lot of rage,” said her daughter. “She was always yelling and screaming, just hating life in general.” Once the resident was weaned off the medications, she became friendly and social. Her case exemplifies how abusing drugs to subdue patients is both ineffective and harmful.
